TERMS AND CONDITIONS

  1. Scope of application and contracting parties

The following general terms and conditions (GTC) apply to all orders placed by a consumer or a company (Customers) via our online shop.

The contracting party of the customer is the company BRANEN AUTOMOTIVE S.L., with registered office at: Pº ERMITA DEL SANTO -28011 MADRID .- SPAIN.

Contrary or additional general terms and conditions of business, which may be used by an entrepreneur, are hereby rejected. They will only become part of the contract if we expressly approve them.

  1. Ordering

Orders in our online shop are placed via the brand selector without the need for a customer account.

If you wish, you can also place your order via a customer account where you will find your saved data and information about your orders.

In addition, you can use the “Add to wish list” button at the bottom of each product page to save your individual product selection in your customer account and print it out as a non-binding offer. You can also save the product configuration with a “direct link” and access it at any time with the updated price via this link.

  1. Conclusion of the contract

By listing our products in the online shop, we make a binding offer for the conclusion of a contract for these articles. You can add a product to your basket without obligation and check and correct your order at any time before sending your binding order. The contract comes into effect as soon as you accept the offer by clicking on the “Buy” button. We do not require a minimum order quantity.

We will file the text of the contract and send you the confirmation of your order together with the general terms and conditions and the cancellation instructions by e-mail immediately. The current version of the GTC can be accessed and downloaded at any time on the pages of our online shop. You can view your previous orders in your customer account. The version of the GTC valid at the time of purchase will not be archived.

The contract can be concluded in English.

  1. Ordering the COC document

4.1 Vehicle data requirements

You must ensure that the data entered in the form corresponds to the data of your vehicle. It is important that you attach the documents clearly so that we can check the VIN. In the checkout on the website, you can also enter the VIN of your vehicle and the date of first registration in the country of first registration.

4.2 Transmission of vehicle data.

You have different possibilities to transmit your vehicle data to us.

In the brand selector on our website, you can choose “vehicle type”, “brand”, “type of vehicle”, “make”, “model”, “type of vehicle”, “type of vehicle” or “make”. and “make”.

Once you have chosen these 2 criteria, you can fill in the purchase form, where you have to attach your vehicle documents, invoicing data and shipping documents.

By clicking on the “Order” button, you authorise your data to process the order of your document.

4.4 Delivery of intermediate products

Once the COC is available, we will send you an advance copy via email, prior to delivery by courier.

  1. Information regarding the right of withdrawal

Customers are not granted a voluntary right of withdrawal.

The right of withdrawal does not apply to contracts for the supply of goods made to the specifications of the consumer and user or clearly personalised.

In all other cases, there is a statutory right of withdrawal for consumers, as explained in the instruction on withdrawal.

To exercise the right of withdrawal, you must notify us (to BRANEN AUTOMOTIVE S.L., with postal address at Pº Ermita del Santo 28011 MADRID, or at the email info@certicoc.com the decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, fax or email). You may use the model withdrawal form below, although its use is not obligatory. In order to meet the withdrawal period, it is sufficient that the communication concerning your exercise of the right of withdrawal is sent before the withdrawal period expires.

Consequences of withdrawal

In the event of withdrawal on your part, we will reimburse to you the payments you have made, including the delivery costs (with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive type of ordinary delivery offered by us) without undue delay and, in any event, within 14 days from the date on which we were informed of your decision to withdraw from this contract. The refund will be made using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise. We will not charge you any fees as a result of the refund. We may withhold reimbursement until we have received the goods back, or until you have provided proof that you have returned the goods, whichever is the earliest.

The deadline will be deemed to have been met if you return the goods before the 14-day period has expired.

Cancellation form

  1. Refunds

Refunds shall be made to the account used for payment. For payments on account or advance payments by bank transfer, the refund will be sent to the account from which the payment was made. If you pay by PayPal/credit card, the refund will be made to the account associated with your PayPal/credit card account.
