TERMS AND CONDITIONS

1. Scope of application and contracting parties.

The following general terms and conditions (GTC) apply to all orders placed by a consumer or a company (Customers) via our online shop.
The contracting party of the customer is the company BRANEN AUTOMOTIVE S.L., with registered office at: Pº ERMITA DEL SANTO -28011 MADRID .- .(SUPPLIER).
Contrary or additional general terms and conditions of business, which an entrepreneur may use, are hereby rejected. They shall only become part of the contract if we expressly approve of them.

2. Ordering.
Orders in our online shop are placed via the brand selector without the need for a customer account.
If you wish, you can also place your order via a customer account where you will find your saved data and information about your orders.
In addition, you can use the “Add to wish list” button at the bottom of each product page to save your individual product selection in your customer account and print it out as a non-binding offer. You can also save the product configuration with a “direct link” and access it at any time with the updated price via this link.
3. Conclusion of the contract
By listing our products in the online shop, we make a binding offer for the conclusion of a contract for these articles. You can add a product to your basket without obligation and check and correct your order at any time before sending your binding order. The contract comes into effect as soon as you accept the offer by clicking on the “Buy” button. We do not require a minimum order quantity.
We will file the text of the contract and send you the confirmation of your order together with the General Terms and Conditions (GTC) and the cancellation instructions by e-mail immediately. The current version of the GTC can be accessed and downloaded at any time on the pages of our online shop. You can view your previous orders in your customer account. The version of the GTC valid at the time of purchase will not be archived.
The contract can be concluded in English.

4. Ordering the COC document

4.1 Vehicle data requirements
You must ensure that the vehicle data matches the vehicle data of your vehicle. It is important that you attach the documents clearly so that we can check the VIN. In the checkout on the website, you can also enter the VIN of your vehicle and the date of first registration in the country of first registration.

4.2 Transmission of vehicle data.
You have different possibilities to transmit your vehicle data to us.
In the brand selector on our website, you can choose “vehicle type”, “brand” and “country of registration”. , “make” and “country of first registration”.

Once you have chosen these 3 criteria, you can fill in the purchase form, where you must attach the documentation of your vehicle and the invoicing and shipping details of the documentation.
By clicking on the “Order” button, you authorise your data to process the order of your document.

4.4 Shipping Policy

The delivery times shown on our website are merely informative (estimated) and are typical delivery times and may vary depending on the brand, year of manufacture, etc. …. Prior to delivery by courier, a digital copy will be sent by email. Once the digital copy has been sent, the document will be considered delivered to the customer. The courier delivery time is not considered as part of the delivery time.

Once the COC Certificate is available, it will be sent to you by UPS courier service. In exceptional cases the delivery can be made by another company if deemed necessary. The customer is obliged to attend to the delivery of the document, or in the event that the document cannot be delivered, to collect the document at the access point of the UPS company or the corresponding company.

5. Return policy (Information regarding the right of withdrawal)

Customers are not granted a voluntary right of withdrawal once payment has been made and these terms and conditions have been accepted.
The right of withdrawal does not apply to contracts for the supply of goods made to the specifications of the consumer and user or clearly personalised as in this case.

The supplier reserves the right to cancel the order and terminate the contract if it is not possible to obtain the COC certificate on the basis of the documentation provided by the customer, or if there is no certificate for the vehicle in question. Also in cases where the subcontractor of the certificate does not provide the copy or is late in issuing it. Furthermore, the supplier reserves the right to cancel the order in cases of hindrances, additional expenses, or sudden changes in the subcontractor’s policies.

6. Refund
Reimbursement shall be made to the account used for payment. For payments on account or advance payments by wire transfer, the refund will be sent to the account from which the payment was made. If you have paid by PayPal/credit card, the refund will be made to the account associated with your PayPal/credit card account.
